Commercial Disputes

Civil and commercial litigation

Some people use the term “commercial litigation”, but we always seek to resolve matters intelligently, often before court proceedings.

Litigation is often expensive, uneconomical and time consuming, and the inherent element of risk involved always exposes parties to the possibility of an unsatisfactory result. Our experience is that those who allow matters simply to proceed to litigation risk a lose/lose outcome when better strategies can minimise risk and costs.

We endeavour to help our clients use ADR to resolve commercial disputes. We explore mediation and arbitration as options to bring about satisfactory closure to a dispute, leaving open the possibility of maintaining working business relationships between parties.

However, sometimes litigation is unavoidable, and in those circumstances we provide practical, realistic and strategic advice in relation to clients’ problems. We advocate strongly and professionally for our clients’ cause, but always with a view to achieving the best outcome in accordance with our clients’ instructions.

We have wide ranging experience in disputes, including:-

  • building and construction law
  • contract disputes
  • professional negligence
  • trade practices
  • partnership agreements and company disputes
